These Terms and Conditions (“Terms”) govern your use of the Classroom Reimagined mobile and web application (“App”), owned and operated by Design Emerging LLC. (“Design Emerging,” “we,” “our,” or “us”). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.

1. Eligibility
• You must be at least 18 years old, or have the consent of a parent, guardian, or school administrator if under 18, to use the App.
• Schools, institutions, and organizations accessing the App must have authority to bind their entity to these Terms.

2. License to Use
• We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App.
• You may not attempt to reverse engineer, hack, or misuse the App.
• You are solely responsible for your activity on the App.

3. Accounts and Access
• Individual Users (Freemium & Subscription): May register for free or purchase a subscription ($39/year) for additional features.
• Institutional Users: Schools, districts, or other organizations must enter into an institutional license agreement.
• Sponsorship Users: Corporate sponsors are subject to separate agreements.
• You are responsible for maintaining the confidentiality of your login credentials.

4. Subscriptions, Fees, and Payments
• Subscription fees are billed annually unless otherwise stated.
• Institutional licenses and sponsorship fees are billed as agreed in separate contracts.
• Payments are non-refundable except as required by law.
• We may change pricing at any time, with notice provided to current subscribers.

5. User Content and Intellectual Property
a. User-Uploaded Content
• You retain ownership of all content you upload (e.g., classroom images, text).
• You are solely responsible for ensuring that your uploaded content does not infringe on any third-party copyrights, trademarks, or other rights.
• By using the App, you agree that Design Emerging is not responsible for any copyright infringement arising from your use of uploaded material.
b. AI-Generated Images and Outputs
• All images, renderings, and visualizations generated by the App are yours to use freely — for personal, educational, commercial, or promotional purposes, without restriction.
• Design Emerging makes no claim of ownership over AI-generated content created by users.
• All images, renderings, and visualizations generated by the App are owned by you. By using the App, you grant Design Emerging a non-exclusive, royalty-free, worldwide license to use, reproduce, and display AI-generated images you create solely for research, analytical, or publication purposes. Such use will not include commercial resale or redistribution without your explicit consent.
c. Responsibility for Use
• You accept sole responsibility for how you use generated images and content.
• If you combine generated outputs with copyrighted materials, you are fully responsible for ensuring your use complies with applicable copyright laws.

6. Data Privacy
• Personal data is collected and processed in accordance with our Privacy Policy.
• Classroom images and inputs are used only to provide App functionality and are not sold to third parties.
• For institutional users, compliance with FERPA, COPPA, and other education privacy regulations will apply.

7. Acceptable Use
You agree not to:
• Upload unlawful, offensive, or infringing content.
• Use the App to harass or harm others.
• Interfere with App functionality or security.

8. Disclaimers
• The App provides design visualizations and educational insights only. It is not professional architectural or engineering advice.
• Visualizations are illustrative and not intended for construction or safety certification.
• The App is provided “AS IS” without warranties of any kind, express or implied.

9. Limitation of Liability
• To the fullest extent permitted by law, Design Emerging shall not be liable for any indirect, incidental, special, or consequential damages.
• Our total liability in connection with the App shall not exceed the fees paid by you in the 12 months preceding the claim.

10. Termination
• We may suspend or terminate access if you violate these Terms.
• You may cancel your account at any time, but fees are non-refundable.

11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to conflict-of-law rules.

12. Dispute Resolution
• Any disputes shall be resolved through binding arbitration in Minneapolis, MN, unless prohibited by law.
• Class actions are not permitted.

13. Changes to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted in the App, with notice provided to users when material changes occur. Continued use of the App after changes constitutes acceptance.
