By using the App, you consent to the practices described in this Privacy Policy.

  • Account Information: Name, email address, school      affiliation, and login credentials.

  • Payment Information: Processed securely by      third-party providers; Design Emerging does not store credit card details.

  • User Content: Photos, classroom images, text      inputs, and other materials you upload.

b. Information Collected Automatically

  • Device Information: Device type, operating system,      browser type.

  • Usage Data: Log files, IP addresses, crash      reports, interactions with App features.

  • Cookies & Analytics: Used to improve App performance      and usability.

c. Institutional Data

  • For schools and organizations,      administrators may provide rosters, classroom images, or other data to      enable educational use.


2. How We Use Information


We use collected information to:

  • Provide and improve the App.

  • Generate AI-powered      visualizations and design recommendations.

  • Manage accounts, subscriptions,      and payments.

  • Communicate with users (support,      updates, notifications).

  • Ensure compliance with applicable      education privacy regulations.

  • Conduct research and analytics in      anonymized, aggregated form.


3. User Content and AI-Generated Outputs


a. User-Uploaded Content

  • You retain ownership of all      content you upload (e.g., classroom photos, text).

  • You are solely responsible for      ensuring your uploaded content does not infringe on third-party      intellectual property rights.

  • Design Emerging is not      responsible for copyright violations arising from user-uploaded content.


b. AI-Generated Outputs

  • All images, renderings, and      visualizations generated by the App are owned by you.

  • You may use generated outputs      freely for personal, educational, commercial, or promotional purposes.

  • Design Emerging does not claim      ownership over user-generated outputs.

  • All images, renderings, and visualizations generated by      the App are owned by you. By using the App, you grant Design Emerging a      non-exclusive, royalty-free, worldwide license to use, reproduce, and      display AI-generated images you create solely for research, analytical, or      publication purposes. Such use will not include commercial resale or      redistribution without your explicit consent


4. Data Sharing & Disclosure


We do not sell or rent personal information. Data may be shared:

  • With Service Providers: Payment processors, hosting      providers, analytics services.

  • With Schools/Institutions: For authorized educational      purposes.

  • For Legal Reasons: If required by law, regulation,      or legal process.

  • In Business Transactions: If Design Emerging undergoes a      merger, acquisition, or sale.


5. Children’s Privacy (FERPA/COPPA Compliance)

  • The App may be used by children      under 13 only with parental consent or under school      administrator authorization.

  • Only minimal data is collected to      provide educational functionality.

  • Parents, guardians, or school      officials may request access to, review, or deletion of a child’s data by      contacting us.


6. Data Retention

  • Account data is retained while      your account is active.

  • Classroom images and uploads may      be deleted upon request or automatically after account termination.

  • Aggregated, anonymized data may      be retained indefinitely for analytics.


7. Data Security

  • We use encryption, secure      servers, and restricted access to protect personal data.

  • However, no system is completely      secure; users share information at their own risk.


8. International Users

  • Data is processed and stored in      the United States.

  • By using the App, you consent to      data transfer to the U.S.


9. Your Rights & Choices


Depending on your jurisdiction, you may have the right to:

  • Access, correct, or delete your      personal data.

  • Restrict or object to processing.

  • Withdraw consent (where      applicable).

  • Request copies of data in a      portable format.
